Legal Changes

The first beer gardens popped up in Germany in the 1500s. Upon hearing of the Brauordnung,  or “beer regulations,” the people of Bavaria learned that they were forbidden to brew between September 29 and April 23—two national feast days. Beer kettles were heated with coal, which were causing building fires throughout Europe. In response, Brauordnung was enacted to protect people from the danger.

restaurantDespite the law, Bavarians continued drinking for those five months. The beer brewed during the winter was stored in underground cellars near the Isar River and covered with ice. Above ground, the breweries covered their properties in shady chestnut trees to further insulate the barrels.  

Outdoor Bars

People began to gather under the trees between May and September in search of shade and a cool drink. To accommodate these patrons, the breweries laid gravel and furniture out for people to sit and enjoy their summer stash. By the early 1880s, these “beer gardens” had become an extricable part of daily life, and other restaurants were losing customers. In response, a law was passed that prohibited these establishments from selling any kind of food besides bread, and the term “biergarten” was born.
