One of the most stressful aspects of an auto collision is handling the insurance. While the jargon alone can make the process challenging to navigate, a significant hurdle is understanding who’s at fault. This process varies from state to state, and in Minnesota, it depends on if there were any injuries. Here’s what you need to know.

In the Event of Injuries

If there are injuries, Minnesota operates on a no-fault system. Every state resident who is a licensed driver must have personal injury protection, or PIP, insurance. If you sustain an injury during an auto collision, your insurance company will cover certain costs, regardless of who is at fault. These costs include medical expenses, income loss if you’re unable to work due to the accident, and funeral expenses. However, the insurance does not cover auto body repairs. This is handled by two different types of coverage: liability and collision.

Liability & Collision Coverageauto collision

Liability coverage is used when you’re at fault for an accident and have damaged someone’s vehicle. Collision coverage, on the other hand, is used when your vehicle is damaged by someone else. Insurance adjusters determine fault and liability, who rely on factors like independent eyewitnesses, damage to the cars in question, and medical records.  Since most auto collisions cause damage to multiple vehicles, Minnesota law utilizes a statute called modified comparative negligence to apportion liability between the parties. If you are deemed to be 25% at fault, for example, you will only be entitled to recover 75% of the damages. However, if you’re found to be more than 51% at fault, you will not be entitled to recover any damages.
