Driving under the influence is one of the most serious moving violations you can face, with penalties that may impact your life for years to come. While DUIs are typically misdemeanors, in some cases you may be charged with a felony, especially if you cause an accident in which someone is injured or killed. If you’ve been accused of drunk driving, hiring a DUI lawyer is crucial for achieving the best outcome possible. Read below to learn the difference between misdemeanor and felony charges.

DUI Misdemeanors & Felonies

Misdemeanor Charges

If you have no previous convictions for driving under the influence, you will likely be charged with a misdemeanor, punishable by up to one year in jail. In Alabama, you will also lose your license for at least 90 days and have to attend DUI school for your first offense. Second and third convictions within a five-year period are also considered misdemeanor offenses, with increasingly severe penalties. For instance, a third conviction carries a minimum 60-day jail sentence, a one-year license suspension, and fines of up to $10,000.

When is a DUI a Felony?

dui lawyerWhether a DUI is considered a felony depends largely on your criminal record and the circumstances surrounding the incident. In Alabama, for instance, a fourth conviction within five years is a Class C felony, which could result in spending one to 10 years in jail. Drivers convicted of a felony will also be fined up to $10,000 and will lose their driver’s licenses for five years. If you caused an accident while under the influence, were arrested for a DUI while children under 14 years of age were in the vehicle, or had a blood alcohol content of 0.015% or higher, the state may charge you with an aggravated DUI, which doubles the minimum penalties you might face.
