If you’re involved in a car accident with a reckless, distracted, or drunk driver, it’s only reasonable to assume that he or she will cover all resulting damages. After all, you were not at fault for the collision. In many states, this would be an accurate assumption, but in Kentucky, the laws are a bit different. Here is what you should know about covering medical expenses following a motor vehicle collision in the Bluegrass State.

The First $10,000

car accidentKentucky follows a no-fault system when it comes to car accidents, which means all parties involved must file insurance claims with their own providers, regardless of fault. Even if you are hurt in a wreck that was caused by someone who was clearly intoxicated, you would file a claim under your own personal injury protection coverage. Also known as PIP, these no-fault benefits will cover the first $10,000 in medical expenses. Any passengers who were riding in the vehicle at the time are also entitled to $10,000 each under the car’s PIP coverage.

Additional Medical Expenses

It is not uncommon to incur far more than $10,000 in medical bills for treating moderate to severe injuries. Once all your PIP coverage has been exhausted, your health insurance provider will take over. If you were not at fault for the accident, though, the insurance company will forward all medical bills to the liable party's provider for reimbursement. You will still be responsible for deductibles and copays, but if the losses you incur are significant, filing a personal injury claim can result in funds for such expenses.
