MR. CORLETTA OBTAINS AN OUTRIGHT DISMISSAL OF CHARGE IN ACCIDENT CASE.

Using an argument he had used before, based upon his knowledge of the law, Mr. Corletta obtained an outright dismissal of a serious traffic charge, wherein the client was involved in an accident, in People v. BB (Greece Tn. Ct., 10/20).

In that case, the client made an illegal U-turn, causing a motor vehicle accident. However, the arresting officer charged the client with a different offense, which did not fit what the client allegedly did. Using his decision in a similar case, People v. Scanlon 63 Misc3d 697 (2019), which was published in a leading legal newspaper in the area, Mr. Corletta made the same argument, and obtained a dismissal without opposition from the Prosecutor.

As a result, the client's driving record was preserved, and the client’s possible liability in an accompanying civil case appreciably lessened.
