The criminal code covers a wide range of offenses, from simple DUIs to complicated money laundering schemes. Some of these charges may result in nothing more than fines and a few marks on a criminal record, while others carry penalties, including jail time. This guide explains a few common types of offenses and their consequences.

What Are Common Criminal Offenses?

1. Driving Under the Influence (DUI)

Due to the dangers of intoxicated driving, DUIs are among the most serious traffic infractions. In Arizona, any driver with a blood alcohol content of 0.08% or above is automatically considered impaired. However, those under 21 can be charged if they have any alcohol in their systems at all.

Anyone convicted of a DUI will be jailed for at least 10 days and face fines no less than $1,250. Their driver’s license will also be revoked for at least one year, and they’ll likely have to complete a drug and alcohol rehabilitation course.

2. Drug Possession

DUIPenalties for possessing illegal substances vary, depending on the type of drug, the quantity, and prior criminal history. Possessing small amounts of any drug for personal use is considered a felony, punishable by a maximum of up to one year in jail for first-time offenders. However, people who have been convicted of a felony in the past may face a prison sentence of three years and nine months.

3. Burglary

Burglary, also known as breaking and entering, is also considered a felony in Arizona. The type of charges depends on criminal records, any resulting injuries, and the value of the goods taken.

For a third-degree burglary, defendants face up to three years and nine months in prison, but those penalties increase dramatically if a weapon was used in the crime. In these cases, a conviction may result in up to 21 years in prison, especially if anyone was injured.
