Since every family is unique, it’s reasonable to assume that every divorce is, too. While this is true to some degree, there are only a few paths that the proceedings can ultimately take. If you’ve decided to end your marriage, a strategic divorce attorney can help you determine the best course of action given the circumstances. You can learn more about the various approaches, which sometimes overlap, below.

4 Common Types of Divorce

1. No-Fault Divorce

In generations past, couples could only pursue divorce on certain grounds, like adultery, cruel or inhuman treatment, or desertion. Today, however, every state will approve divorce merely for irreconcilable differences. Often called no-fault divorce, its proceedings are fairly straightforward—as long as both parties agree to the terms of the split.

2. Collaborative Divorce

A collaborative divorce is one in which both parties are willing to compromise so they can avoid the hassle of litigation. While they might still hire their own divorce attorneys—as they should in order to protect their best interests—they will negotiate with each other outside of the courtroom to devise a separation agreement that both deem satisfactory.

3. Contested Divorce

divorce attorneyContested divorces don’t necessarily have to be as stressful as they appear. When a couple cannot agree on the terms of the split, they have no choice but to go to court. After reviewing the evidence that each side presents, a family law judge will issue appropriate rulings.

When determining custody, the court’s primary concern will be the best interests of the children involved. When dividing assets, on the other hand, the judge will aim to do so equitably.

4. Mediated Divorce

When a couple is having trouble coming to an agreement, but they’re determined to stay out of court, they might try mediation. During this proceeding, a neutral third party facilitates the negotiations so the couple can arrive at a resolution for each contested issue. It’s wise to seek representation before attending mediation because the mediator is not responsible for protecting either party’s interests. Only an attorney can help you propose strategic compromises that are in your favor.
