MR. CORLETTA OBTAINS ANOTHER DISMISSAL OF DOMESTIC VIOLENCE CHARGE

In a case where the client was on Interim Probation, and could have been violated based upon a conviction, Mr. Corletta obtained an outright dismissal of a Domestic Violence charge in People v. R. D. (Roch,. City Ct., 8/20).

In that case, Mr. Corletta obtained Discovery and after reviewing same, recognized several flaws in the People’s case. He subpoenaed 2 material witnesses who knew the Complainant.

On the day of trial, the Complainant contacted the District Attorney, stating they did not wish to go forward, probably because they found out their testimony would be directly impeached by the witnesses Mr. Corletta subpoenaed.

In properly preparing for trial, Mr. Corletta did his client a service, and essentially forced the complaining witness to withdraw their baseless claim without even coming to Court.
