While some states have moved toward legalization, marijuana remains a Schedule I controlled substance in Nebraska. 3 Common Drug Charges in Nebraska

1. Paraphernalia

You can be convicted of a drug charge even if the actual substance remains undiscovered. If you are found with drug paraphernalia—items used to take drugs, or accessories associated with drug use—you may be penalized.

For example, those caught with a bong or pipe used to smoke marijuana may be fined $100 for the first infraction. If you are caught selling one of these items, you may receive up to six months of jail time and $1,000 in fines.

2. Possession

drug chargesIf you are caught with an illegal drug in your possession, you will be subject to more severe penalties. In Nebraska, anything over an ounce of marijuana could result in three months of jail time and a $500 fine.

Any detectable amount of heroin is considered a Class IV felony, which can result in up to two years in prison and $10,000 in fines. If you are caught with any detectable amount of cocaine, you could face a $50,000 fine and up to five years in prison.

3. Sale

Those charged with the sale of marijuana will be subject to a Class III felony. This will result in anywhere from one to 20 years in prison and a fine of up to $25,000. If you are charged with a second offense, you’ll be penalized with three to 50 years of jail time.

The sale of 10 to 28 grams of cocaine could result in a Class ID felony, which also comes with three to 50 years in jail. The penalties for all drugs and controlled substances increase if the sale is performed within 1,000 feet of a school, or to a minor.
