It's common for local law enforcement to set up DUI checkpoints within their communities, maintaining safety and ensuring everyone's driving sober. If they suspect a drunk driver, they'll ask them to pull over to the side of the road. Since this can be slightly unnerving, knowing what to expect could put your mind at ease and help you determine when to contact a lawyer.

4 Steps for a DUI Investigation

1. Initial Stop

Officers tend to watch for constant swerving or sudden traffic violations, which are common signs of impairment. If you present a potential risk, they have every right to pull you over. Otherwise, without reasonable cause, a lawyer will say they have no case and no reason to detain you.

2. Officer Evaluation

lawyerOnce the vehicle has come to a complete stop, the officer will approach the driver's side window and ask for your license and registration. They'll take note of your actions, such as fumbling with the documents or slurring your speech, and try to detect any smells of alcohol that may be lingering.

3. Further Questioning

If they suspect that you’ve been drinking, they’ll start asking a series of questions about your recent activities. Answers that reveal you might be under the influence could result in a few roadside tests. These include walking a straight line, standing on one leg, and following a pen with your gaze as it moves from side to side. They may also ask for a breathalyzer test to measure blood alcohol concentration.

4. Immediate Arrest

Those who are unable to pass the tests could be looking at an arrest. The officer will take away their driver's license and transport them down to the local jail or police station for processing. Someone will have to post bail to secure their release. Then, they'll have to obtain a lawyer for the upcoming court date, which will determine the penalty for driving under the influence.
