The U.S. Social Security Law was enacted in 1935 to provide income to retirees and people with disabilities. According to the National Academy of Social Insurance, approximately 61 million Americans collect Social Security benefits each month. If you’re planning to collect, it’s wise to contact a social security disability attorney to help you apply. In the meantime, learn the basics of eligibility below.

At What Age Can I File?

You can apply for and begin receiving social security retirement benefits as early as age 62. However, you are not entitled to receive full benefits until you reach full retirement age (FRA), which is determined by the year you were born. For example, if you were born between 1943 and 1954, you’ll reach FRA at age 66, but if you were born between 1956 and 1959, you wouldn’t hit FRA until you’re 67.

In addition, if you delay applying for benefits until after your full retirement age, your monthly benefit may be increased until you reach the age of 70. A social security disability attorney can help you figure out your FRA and determine if it makes sense for you to file for benefits early due to a physical disability.

Are There Any Exceptions?

North Carolina social security disability attorneyYou can apply for social security retirement benefits four months before they start. So, if you’d like your benefits to start at the age of 62, you can apply when you are the age of 61 and eight months. If you’re the spouse, current or ex, or a family member of a worker who has passed away, you may be entitled to receive survivor retirement benefits. Working with an experienced social security disability attorney is the best way to determine when and how you should apply.
