If a loved one passes unexpectedly and they didn’t mention their car in their will, it can leave you wondering who takes over the car title. Surviving family members will need to determine who will be the owner and then follow the proper steps to secure ownership. Below, learn what the situation entails and how to navigate the process smoothly.

How the Title Is Handled

If you had joint ownership of the vehicle, you would take over full ownership once the other joint owner passes. Vehicles mentioned or not mentioned in a will or estate plan may pass through probate before they’re released to a designated person or the family. In this case, the family will need to decide which person will adopt ownership. It may also have to be decided in probate court. The spouse is usually the first heir with the option to take ownership. Children are next, and then parents, siblings, or other close relations.

There may also be a lien on the vehicle to cover the outstanding debt. You’ll be responsible for resolving the debt with the creditor and having the lien removed. The new owner will also need to complete outstanding auto loan payments on the vehicle, so you may need to do some financial planning before taking ownership.

How to Transfer Ownership

car title You can start the car title transfer process following probate or after satisfying a lien. Gather the death certificate, car registration, and the original title with a Release of Liens section if applicable. Cars that have gone through probate require a letter from the probate judge that names the administrator of the estate. Vehicles issued through a will require a letter from the officer of the court.

Your Department of Motor Vehicles can transfer the title and registration to your name, and you’ll then take ownership of the vehicle. It’s important to contact the previous car insurance provider to make the necessary changes.
