If you experience an on-the-job injury—or develop a condition related to your job—you are entitled to workers’ comp. However, each state has its own rules regarding how to seek this compensation. If you are a Kentucky resident, the guide below looks at what you can expect from this process.

What to Know About Workers’ Comp in Kentucky

What does it cover?

You can file a claim for any physical injury that occurs on the job site. It could be a gradual issue that develops over time—such as hearing loss—or a sudden incident—like a fall. Compensation can include money for your medical treatments, lost wages, and rehabilitation, as well as permanent disability benefits, depending on your situation.

Are there any exemptions?

workers' compYes. Some industries are not required to provide workers’ compensation to their employees—including agricultural businesses. Other exemptions include private residence staff, contractors who work less than 20 days, and those who receive sustenance or aid from a local organization for their services.

In some cases, your employer may also try to dispute your claim by saying that it was not sustained at work.

How does one file a claim?

First, alert your employer to the incident as soon as possible. They may have office paperwork for you to complete. You’ll then have to fill out an Application for Resolution of Injury Claim and submit it to Kentucky’s Department of Workers Claims.

Is there are a time limit?

Kentucky provides two years to file a workers’ compensation claim, starting from the date of the injury or the last payment of Temporary Total Disability (TTD). Injuries that result from a viral exposure can be reported up to five years afterward since symptoms may take a while to become apparent.

However, it is in your best interest to submit a claim as early as possible. This reduces the opportunity for your employer to suggest you obtained your injury elsewhere.

Will I require an attorney?

While not always necessary, an attorney’s knowledge of the system can make this process less stressful. Additionally, if your employer disputes your claim, they can help gather evidence for your case and represent you in court. Lastly, they will be able to determine what types of compensation you qualify for and will fight to get you that full amount so that your focus can be on healing rather than the financial costs involved.
