Same-sex couples have been lobbying to enjoy the same rights as heterosexual couples for decades. Thanks to that fight for equality, gay and lesbian couples are now able to adopt children in many parts of the country. As gay adoption laws vary by state, use this guide to learn how the legislation pertains to same-sex couples in Arizona.

Arizona Permits Joint Adoption Petitions by Married Couples

Mississippi is the only state that prohibits same-sex couples from adopting entirely. In Arizona, there are no specific statutes banning married LGBT couples from petitioning jointly to adopt children. Unmarried gay and lesbian couples can’t adopt jointly in Arizona, but this applies to heterosexual couples as well.

Couples must own a home and pass FBI and criminal background checks to be approved. The process also includes home visits to ensure the child will be raised in a safe and healthy environment.

Stepparent Adoption

Arizona adoption law doesn’t prohibit single individuals over the age of 18 from adopting children. If your significant other has already adopted a child, you can also become the minor’s legal guardian through stepparent adoption. The state doesn’t have any legislation prohibiting this type of adoption by LGBT couples.
