Getting pulled over for a DWI can be a startling experience, especially when you don’t know what to expect. And because you don’t have an attorney with you, it’s possible to say or do something that can worsen the situation. Following the tips below can help protect your rights when you’re pulled over and must wait to contact a lawyer.

Pull Over Immediately

When you notice the police lights and hear the siren, pull over to a safe area on the side of the road as soon as you can. Any serious delay might lead the officer to think you’re not going to cooperate and will try to flee the scene.

Once you’re stopped, turn off the ignition and get your license and registration ready. Stay seated in your car unless you’re instructed by the officer to get out.

Speak as Little as Possible

Missouri attorneyWhile it’s important to be agreeable and polite so as not to escalate the situation, any attorney will tell you that the less you say and do, the better. The officer will be looking for signs that you are under the influence—they may check the smell of your breath for alcohol, for example, or watch to see if you’re slurring your speech.

You do not have to answer questions about whether you were drinking, but if you do offer information, you cannot lie; the safest action to take is simply to stay quiet. Once you have provided the officer with all the essential documents, you can politely tell him you do not wish to answer any questions without an attorney present.

Refuse Searches & Field Sobriety Tests

If the officer asks to search your vehicle, you may politely decline. You also have the right to refuse a field sobriety test, which typically includes requests like walking a straight line or standing on one leg.

If you are arrested, however, you will be required to submit to chemical testing of your blood and urine. Refusing to comply with this request can result in the suspension of your driver’s license for at least 30 days.
