Although some divorce proceedings may take months, decisions such as child custody are too urgent to be delayed. To help speed this process, a family attorney can help you receive a temporary order. The guide below will give you some insight into the process of obtaining one.

What Is a Temporary Order?

A temporary order allows for a judge to decide on urgent issues before the end of a divorce proceeding. They include:

  • Child custody
  • Spousal and child support
  • Possession of critical assets, such as a home or a car
  • Health insurance and medical expenses

Since the decisions are temporary, the hearing to discuss these issues is often quicker compared to traditional hearings. However, family attorneys advise that the decisions made in a temporary order hearing may affect the final outcome.

How Can You Get a Temporary Order?

Family AttorneyTemporary orders are placed into effect by the Court after a motion is filed by either party requesting relief from the Court.  To start the process, one party must file a Petition for Dissolution of Marriage pleading followed by a motion requesting the temporary relief.

These documents allow one spouse to ask for a court hearing and provide an explanation for their request. A signed, written verification as to the contents of the documents is also needed to further justify this request. If the documents are accepted, a hearing will be scheduled to take place.

If both parties cannot reach an agreement on the relief requested, a judge will decide the issue or issues for them following a temporary hearing. When the judge enters a temporary order, it will remain effective until divorce proceedings are finalized.
