If you’re caught operating a vehicle in Texas while intoxicated, you’ll be charged with a DWI. Intoxication includes the use of alcohol, drugs, or other substances that inhibit your mental or physical faculties. It also doesn’t matter what kind of vehicle you’re operating—whether it’s a car or a boat. Penalties for Multiple DWI Convictions in Texas

First Offense

For adults over the age of 21, the first offense will be a class B misdemeanor, which results in up to 180 days of jail time and $2,000 in fines.

Those between ages 17 and 20 will receive the same penalties, as well as a 1-year license suspension or a 90-day suspension with the installation of an ignition interlock device. This requires the driver to pass a breathalyzer test for the car to start.

Those under the age of 17 will receive a class C misdemeanor, which includes up to $500 in fines, a 60-day license suspension, 20-40 hours of community service, and an Alcohol Awareness Course

Second Offense

dwiConsequent offenses will rise to a class A misdemeanor, as well as fines of up to $4,000. Those convicted could face a jail sentence of 1 year, though aggravating factors may increase this. 

Third Offense

By the third offense, you’ll be charged with a third-degree felony and up to $10,000 in fines. You may also be subject to 2 to 10 years of state prison time. However, if you’ve already been incarcerated in the Texas Department of Criminal Justice in the past, your third DWI will be considered a second-degree felony, and you could face up to 20 years in jail.

Fourth Offense & Beyond

After three DUIs and a resulting prison sentence, a fourth DWI will be considered a second-degree felony. It will come with another fine of up to $10,000 and another 2 to 10 years in jail. Fifth and subsequent charges could result in anywhere from a prison sentence of 25 years to life.
