What is a restraining order?

A restraining order is a civil order issued by a Superior Court against someone who is not under arrest but has threatened or caused physical injury or pain to a person in their household or family. The court order can include that the person must stay away from you, not to sexually assault, harass or threaten you, your children or pets, and not to go to your family home. An order can last up to a year, and the court has the power to extend it.

Family and household members include relatives, spouses or former spouses, people who were or are dating, and people who have a child together but were never married. If you’re in a same-sex relationship, you can apply for protection from a former or current spouse or partner.

You can apply without an attorney. You must complete the forms available at courthouses throughout the state or use the Application and Affidavit for Relief From Abuse and Request for Nondisclosure of Location Information forms online.
