After you’re convicted of a crime, the item may remain on your record indefinitely. This may present challenges when applying for a job, leasing a home or apartment, or requesting government aid. Luckily, you might be able to expunge your records and pursue your goals with a clean slate. Here’s more about the expungement process in North Carolina.

What You Should Know About Expungement

Who is eligible for expungement?

While more serious convictions can’t be erased from your record, you can apply for the expungement of misdemeanors and level H or I felonies. However, there are exceptions. If you committed a “hate crime,” or if your crime involved controlled substances, commercial vehicles, assault, or sexual offenses, you might not be eligible.

How long after a conviction can a record be expunged?

If you committed a misdemeanor, you’d have to wait five years from the conviction to apply for expungement. Felonies require a waiting period of ten years or more.

What if I wasn’t convicted?

expungementEven if you were falsely accused of a crime, the charges would still remain on your North Carolina record. However, if your charges were dismissed, or if you were found “not guilty,” you are eligible for an expungement.

How many times can I apply for an expungement?

While you might not want to wait any longer with a criminal charge hanging over your head, it’s important to realize that applying is a serious decision. You’re only entitled to one expungement in your lifetime. If you’re charged in the future and have already had your records expunged, these items will remain on there forever.
