Mr. Corletta Helps Single Mother Obtain Judgment for Child Support Arrears and Recommendation of Incarceration for Nonpayment.

 

In a case Mr. Corletta accepted Pro Bono through a local Volunteer Legal Services organization, he helped a client collect over $10,000.00 in child support arrears by obtaining a finding after trial, that the father repeatedly and willfully disobeyed Child Support Orders in Matter of Anonymous v. Anonymous (Mon. Co. Family Ct., 1/20).

          In that case, the father, over an approximate 7-year period failed to pay child support, although the amount was a relatively nominal $59.00/wk. There were numerous excuses, including undocumented medical disabilities.

          The truth was the father's driver license was revoked for nonpayment of fines and Driving While Intoxicated, and that he simply didn’t feel like filing tax returns or running his business in accordance with applicable law, and wanted to do what he wanted to do with whatever money he did earn.  

          The father was repeatedly taken to Court for nonpayment of child support There were at least 2 Judgments, and finally, placement on probation with a direction to satisfy the arrears while on probation.

          The father promptly moved out of the county, ignored that Order, and did not report to probation. When Mr. Corletta got the case, he assembled the prior history of the case, as well as ran social media checks, public record checks, and a license check on this individual.

          Well prepared for the Hearing, Mr. Corletta more than adequately showed the noncustodial parent had not only failed to pay, but also blatantly ignored prior Orders of the Court, including the Order placing him on probation. Mr. Corletta obtained an additional Judgment against the father and a recommendation for incarceration by a Family Court Judge unless all arrears were paid.

          Mr. Corletta’s client, a parent struggling to make ends meet with 2 jobs, was extremely grateful for Mr. Corletta’s vigorous advocacy, thoroughness, and assistance.
