The victim will file a lawsuit against the liable individual, their insurance company, or both parties, depending on the details of the case. The claimant is now the plaintiff, and the other party is the defendant. To file a lawsuit, the plaintiff must follow defined legal channels. This usually starts by filing a formal complaint with the courts, followed by discovery, mediation, injury settlement negotiations, and, rarely, a trial. The terms lawsuit and case are used interchangeably and mean the same thing, but neither one is a claim.
