Legally, pets are considered property, so you can use your will to transfer ownership of your pet to a trusted person or organization. You may also choose to leave your pets’ guardians some money to pay for food, vet bills, and supplies, although they aren’t legally required to do so.

Because the guardian you choose could technically use those funds for anything, many estate planning professionals recommend setting up a living trust for your pets instead.

Establishing a Trust

estate planningAnimals can’t legally own property, so you can’t simply leave them money in your will. However, they can be named as the beneficiary of a living trust, which provides more protection and ensures your pet gets the care and resources they need.

A pet trust is a separate legal entity that allows you to leave resources dedicated to caring for your pet and name a caretaker, who is legally obligated to follow your instructions.

The funds are administered by a trustee, who will decide how they should be spent and give money to the caretaker as needed. If the caretaker uses the money irresponsibly, your trustee can file a lawsuit to enforce the terms of your trust.
