Lab Testing Solutions Update:

 

Important for FMCSA Employers, Medical Review Officers, Substance Abuse Professionals, drivers, or third-party administrators

 

The FMCSA regulations now require that all chain of custody forms (CCFs) for FMCSA testing must be completed using the driver’s Commercial Driver’s License (CDL) number and state of issuance!

 

The FMCSA Clearinghouse is a new system required by the Department of Transportation. It will contain records of drug and alcohol violations, including non-negative drug and alcohol test results and test refusals. The clearinghouse will allow employers to easily identify drivers that are not legally permitted to operate CMVs due to drug and alcohol program violations.

This is not an optional program for FMCSA employers, Medical Review Officers, Substance Abuse Professionals, drivers, or Third-Party Administrators.

 The requirements for the new Clearinghouse program can be found in the Federal Motor Carrier Safety Regulations: 49 CFR Part 382.701 to 382.727 (www.ecfr.gov)

All chain of custody forms for FMCSA testing must be completed using the driver’s Commercial Driver’s License number, and state of issuance. No changes have been made to the current DOT form, since it does not require Social Security Numbers. Collection sites and DERs will need to enter the state of issuance, and CDL number into the employee’s ID field, as shown below:

For DISA to properly process drug tests, the two-character state code MUST precede the driver’s license number.

If the driver refuses to provide the CDL number, FMCSA guidelines state that the collector should proceed collection with the identification number provided by the driver. The MRO and/or DER will contact the employer and/or employee as needed prior to reporting any information to the Clearinghouse.
