What to Do if the Defendant Doesn’t Show Up for Court

1. Find the Defendant

A bail bond is a contract in which the cosigner essentially states that they’ll make sure the defendant shows up to all appointed court obligations. The cosigner, then, needs to know where the defendant is and do whatever it takes to get them to the courtroom at the stated times.

Be relentless in your pursuit. Underscore the seriousness of the situation. If you don't, you could be on the hook for the entirety of the bail amount.

2. Contact the Bail Bond Agent

A cosigner should also work closely with the bail bond agent. You may not know where the defendant is located or you may be uncomfortable approaching them. In both cases, the bondsman can help. They’ll gather details about the defendant and try to track them down; they may hire an outside service to assist, the fee for which will be your responsibility.

3. Pay the Bond

If the defendant can’t be tracked down, the cosigner must repay the bond agent the entire bail amount. Most agencies offer a grace period, so the full total likely won't be due within hours of the defendant jumping bail. But if the defendant can't be found within the statutory period, it’s time to start planning how you will pay the bond.
