Adopting a stepchild is a wonderful way to bring your family together, as it gives you all the rights of a natural parent. While the legal system can be intimidating for parents considering adoption, Missouri makes it a reasonably straightforward process. Understanding what to expect and hiring an adoption attorney will make it easy to become your stepchild’s legal parent.

How to Adopt a Stepchild in Missouri

1. File the Petition

The adoption process begins when you file a petition with the court. Since these documents are often complicated and even minor mistakes can result in frustrating delays, it’s best to let your adoption attorney prepare and submit the petition.

2. Terminate the Natural Parent’s Rights

If the noncustodial parent agrees to the adoption, this step can be relatively simple. Otherwise, you'll have to convince a judge that the other parent is unfit due to abandonment, abuse, neglect, or a medical issue that leaves them unable to care for the child. In Missouri, the child will also have to consent if they're over the age of 14.

3. Conduct a Home Study

If the noncustodial parent voluntarily surrenders their rights, the court will likely waive the home study phase of the adoption. Otherwise, a social worker will visit your home to ensure you're providing a safe, nurturing environment for the child.

4. Finalize the Adoption

Once the other steps have been completed, the court will formally transfer custody of the child, giving you all the rights and responsibilities of a birth parent. These rights won't be revoked if the noncustodial parent changes their mind, you and the birth parent divorce, or your spouse passes away.
