Is a Spouse's Cooperation Necessary?

Although the process of separation and dissolution is smoother when both parties agree, you can still end a marriage to an uncooperative spouse. When your spouse receives your filed papers they are then legally notified of your intentions.

You may choose to use the sheriff’s office or hire a process server to ensure your spouse receives the initial divorce papers.  Your spouse then has a certain amount of time to respond.  

What  Legal Avenues Can I Take?

divorceWhen the proceedings are contested, a hearing will take place where both parties are to appear.  The judge and the lawyers will then discuss steps to resolve the issues and try to get both parties agree to terms.  Mediation is often ordered by the courts.  If mediation is unsuccessful, the court will schedule a contested trial where each side presents evidence on disputed issues.

If your spouse does not show up for required hearings, you can request a resolution by way of judgment.  The court will decide whether to honor requests for child support, the division of assets, and other terms outlined in the divorce papers.
