According to Title VII of the Civil Rights Act of 1964, sexual harassment is a form of sex discrimination. There are many misconceptions around this term and its application, especially in office settings. Here are some of the most common myths when it comes to sexual harassment.

Dispelling Myths About Sexual Harassment

1. It’s Always Sexual

Sexual harassment isn’t restricted to sexual advances. Offenses can be classified either as sex-focused or gender-based. Gender harassment doesn’t involve sexuality or sexual attraction, and it can include symbolic, verbal, and physical behaviors that degrade and insult another. These behaviors may be used to assert power or to control or force employees out of a job because they don't conform to gender stereotypes.

2. Only Women Are Targets

sexual harassmentCourts have established that harassment can be done to anyone by anyone, regardless of gender identity. While sexual harassment victims are often women, even men, gender-nonconforming individuals, and LGBTQ can be at the receiving end of this offense. Also, sexual harassment can take place between persons of the same sex as long as the violation is gender-based.

3. Only Supervisors Can Be Harassers

Aside from superiors and coworkers, an employer's client, contractor, or agent can also be identified as a harasser. Additionally, if the employer knows or should have known about the offense and didn’t take appropriate action, they may be held liable. For instance, employees who have received inappropriate treatment from an office-contracted plumber can file a suit against their company if their employer failed to act on harassment complaints promptly.
