While everyone wants their marriage to be a lifelong commitment, it’s sometimes necessary to hire a divorce lawyer to start proceedings. However, it’s not uncommon for disputes to arise when one partner makes the decision to end a relationship and the other person doesn’t agree. Here’s what you should do if you want to file for divorce and your spouse objects.

3 Steps to Take When Your Spouse Doesn't Sign Divorce Papers

1. Contest

If you're having issues getting your spouse to sign the papers and agree to the terms of the divorce, consider contesting it. Both parties will have to show up to court in front of a judge to state their case. When you're both unable to reach agreements, it will then be up to the judge to decide on the proper settlements in the case, as well as how the property will be divided up between the two parties. A divorce lawyer can represent you during the hearing to help the process run smoothly.

2. Mediation

In these instances, if you do not want to contest the divorce, consider hiring a mediation specialist. They are selected by the divorce lawyers to assist with the case and help both parties reach an agreement.

3. A Divorce by Default

If your other efforts to get divorced don't work, have a divorce by default. If a certain amount of time has passed between the time you filed—typically within 30 days—and your spouse has yet to sign or appear to court, you can file a motion. You will then be required to show up for a hearing, and a judge will make a ruling based on the facts. If your spouse doesn’t show up for the hearing, they wave all of their rights to have a say in the divorce.
