For many people, writing a last will and testament is what comes to mind when they think of estate planning. Doing so ensures that your property and assets are given out according to your wishes after your passing. Here are a few important elements to consider as you write your last will and testament.

What to Consider When Drawing up a Will

1. Executor

The executor is responsible for handling your estate after your death. Because of this, you should name someone who is trustworthy and organized enough to handle the paperwork and duties associated with this role. Make sure that your executor agrees to the job and knows where to access important documents, such as bank statements and real estate deeds. Also, name an alternate option in case your initial choice becomes ill or passes away.

2. Beneficiaries

Remember that you can only bequeath property that you own, such as family heirlooms, land, or money. If you are leaving items to your spouse, include instructions for what should happen if you both pass away.

3. Power of Attorney

Some estate planning documents also give an individual power of attorney, which gives someone you trust the power to act in your name should you become incapacitated. Typically, it’s limited to financial or medical decisions. As with naming an executor, select a trustworthy and competent individual who is willing to shoulder this responsibility.

4. Minor Children

If you have children who are minors, there are some extra items to consider. Name a guardian to care for the children if you and your spouse pass away. Choose someone who will provide a loving and stable home. Assets can also be distributed to children through a trust so that they receive their share upon reaching adulthood.
