Many people ask if their are any ill effects after filing bankruptcy.  For example, do you lose any legal or civil rights?  Since bankruptcy is not a criminal action there is no loss of rights.  What about discrimination after bankruptcy?  The general answer is that it is illegal to discriminate against a person just for filing a bankruptcy.  What about loss of property, is there a chance you can lose your property after filing?  The general answer is not usually.  Bankruptcy allows you to exempt most property that one might have so that it is not exposed to being taken.  The bankruptcy statute, whether State of Federal, has all kinds of specific and general exemptions.  Your attorney will go over your various property and possessions with you to be sure that if you file your property is exempt, i.e., that the property is protected by law from the claims of creditors.  On the other hand, if you have property that is secured by a mortgage or car loan and you don’t continue to make your payments, the creditors could foreclose on it but you would not owe the creditor any money since you listed it on the bankruptcy.  So in general, when you file, you will not lose anything but always make sure you go over the possibilities carefully with your attorney to see if there are any exceptions that could affect your particular case.  For more information, contact Attorney Mark O.
