Although many states across the country have approved new laws to legalize marijuana use for recreational and/or medicinal purposes, it still remains illegal in North Carolina. As such, just being found in possession of the drug is considered a punishable offense. Unfortunately, a conviction can leave you with a permanent criminal record and create major obstacles in your personal and professional life. For this reason, if you’re arrested and charged with marijuana possession, it’s important to have a qualified drug lawyer properly handle your case. In the meantime, here’s a helpful overview of North Carolina’s current legislation on marijuana and the consequences of getting caught with the drug.

How North Carolina Law Treats Marijuana Possession Charges

Classification

Over the years, several marijuana-related bills have been introduced to North Carolina legislature for consideration. However, as of now, the drug remains classified as a Schedule VI controlled substance. This means it is illegal to possess, use, grow, or sell, even for medical reasons.

Penalties

drug lawyerOne of the biggest factors in determining the penalties for a marijuana possession charge is how much you’re found with. Possession of less than a half ounce is a Class 3 misdemeanor with a maximum fine of $200. A first-time offense usually won’t result in jail time, but it’s still important to consult a drug lawyer about fighting the charges to maintain a clean record.

Possession of a half-ounce up to 1 1/2 ounces is also a Class 3 misdemeanor that’s punishable with a $1,000 fine and up to 45 days in jail. Possession of more than 1 1/2 ounces is a Class I felony and carries a maximum of eight months in jail and a $1,000 fine. Possessing any more than 10 pounds falls into the category of drug trafficking and the risk of 25 to 39 months in prison.
