To encourage economic growth and job creation in America, Congress initiated the EB-5 Immigrant Investor Program in 1990. This gives foreign investors the opportunity to get an EB-5 visa and permanent resident status in exchange for starting a new U.S. business or investing capital into an existing one. It has become an increasingly popular alternative to other visas with more rigorous application criteria. However, it does require an extensive amount of documentation. Below is an overview of the paperwork needed when applying for an EB-5 visa.

3 Types of Documents You Need for an EB-5 Visa 

1. Personal Documentation 

All investors looking for an EB-5 visa must provide their personal background information. They must submit copies of their birth certificate, marriage license, a valid passport, prior immigration applications, medical examination and vaccination records, and educational diplomas. Information related to any criminal convictions, time spent in the military, and employment history must also be included.  

2. Project Documentation 

EB-5 visaThe investment requirements for an EB-5 visa include a minimum of $500,000 in targeted areas — such as rural areas with low-employment — or $1,000,000 outside these targeted investment areas. Beginning November 21, 2019, these amounts will increase to $900,000 and $1,800,000, respectively. Investors will need to show proof they’ve invested or are in the process of investing the required amount. They’ll also have to attach a business plan demonstrating at least 10 new full-time jobs will be created. 

3. Financial Documentation 

To ensure the invested money was lawfully acquired by the investor, a variety of financial records must be provided. This includes the last five years of personal and business tax returns, copies of business licenses, the last five years of bank statements, and profit or loss statements for each business they own. Additionally, they must supply evidence of the financial sources used to fund the EB-5 project.
