MR. CORLETTA OBTAINS GREAT RESULT IN HIGH INCOME CHAPTER 7 BANKRUPTCY CASE

 

In In Re Anonymous (USBK, 7/19), Mr. Corletta used his 40 years expertise to navigate his clients through the Chapter 7 Bankruptcy System, despite having income of approximately $100,000.00.

 

The clients had a prior Bankruptcy filing in 2008 under Chapter 13, which was completed in 2013. Within 5 years, the clients were in trouble again, partially due to family circumstances and medical debt, with credit card debt approaching $100,000.00.

 

When Mr. Corletta looked at the situation initially, he warned the clients they may not be eligible for Chapter 7 due to their high income, and the underlying circumstances. Exercising some careful planning over a period of approximately 9 months, Mr. Corletta carefully prepared the Petition and Schedules, monitored their income, and qualified them for Chapter 7.

 

Demonstrating careful preparation of the Petition and Schedules is 80% of any Bankruptcy case, Mr. Corletta went through several drafts of the Petition before filing it. Even the clients became impatient, as some lawsuits from creditors were beginning. Mr. Corletta also successfully fended off the lawsuits in the meantime.

 

Upon filing the Petition, Mr. Corletta showed how careful preparation and planning pay off. Upon attending their Bankruptcy §341 Hearing, the clients were in and out in a brief appearance, with the Trustee subsequently issuing a “No Asset Report”, with the clients on track to obtain their Discharge. Mr. Corletta also successfully handled reaffirmation of 2 vehicles.
