Using your cell phone while driving is dangerous, but it also has financial consequences. Reading or writing a text message or email is prohibited for all drivers in North Carolina unless using a hands-free device. If you're convicted, you face a $100 fine along with court fees. The only exceptions to the rule while in motion are first responders as long as they're performing necessary tasks pertaining to their official role. While the offense may cause an insurance rate increase, it doesn't result in any points given. 

Talking

Currently, it's only illegal for drivers under 18 and school bus operators to talk on the cellphone behind the wheel. In both situations, using a camera or other phone application are also prohibited. Underage drivers caught using a mobile phone face a $25 fine, while school bus drivers face a $100 fine and a Class 2 misdemeanor charge, with neither situation resulting in driver's license or auto insurance points. Even though the law only affects the two categories, the ban could soon be extended for all drivers.

auto insuranceIn early 2019, the North Carolina House of Representatives introduced HB 144. The bill proposes a ban on handheld cell phone usage while driving. Hands-free communication with a mounted phone or built-in vehicle Bluetooth is allowed for individuals over the age of 18. 

While the bill failed to make it past a North Carolina Senate committee in early July 2019, the bill's sponsors plan to present the legislation again in 2020. If passed, drivers convicted of violating the law would face a $100 fine for their first offense. A second offense will result in a $150 fine, and a third offense will cost $200. Receiving more than one conviction in a 36-month period may also cost you auto insurance points.
