Driving under the influence is illegal in the state of Alabama, with serious penalties for those caught inebriated behind the wheel. A first-time DUI charge could mean fines of up to $2,100 and up to one year in jail as well as a 90-day license suspension. For subsequent convictions, the consequences will be even more severe. Here’s a closer look at what repeat offenders can expect.

Second DUI

If someone is convicted of drinking and driving a second time, they’ll face 5 days in jail plus the possibility of a one-year jail sentence. In some cases, the 5 days of jail time can be replaced by 30 hours of community service. The fines may run as high as $5,100, and a one-year driver license suspension is standard.

Third Offense

DUIWith a third DUI offense, the mandatory imprisonment period jumps to 60 days. This can't be exchanged for community service or any other conditions. Again, this initial mandatory sentence may also include up to a one-year jail sentence. The fines are hiked up to a maximum of $10,100. Last but not least, driving privileges will be revoked for not one but a full three years.

Subsequent Offenses

A fourth or subsequent DUI conviction within 10 years will automatically qualify as a Class C felony. Imprisonment for a fourth or subsequent offense can range from a year and one day to 10 years in prison. Fines will run up to $10,100. A five-year license revocation is also applied.

A felony remains on a criminal record forever and can seriously interfere with one’s future chances at job opportunities or even housing options. Since consequences worsen as the convictions stack up, it’s in the defendant’s best interests to fight these charges—even if it’s only the first one.
