People v. Anonymous (Town Court, 7/2019)

 

Mr. Corletta goes “5 for 5” in representing a long-time client of approximately 30 years.

 

Mr. Corletta achieved a rare feat. This client had 5 arrests for Driving While Intoxicated since the mid-1980’s. Mr. Corletta achieved reduction or dismissal in all 5, including the most recent arrest, which under New York’s Multiple Drug and Alcohol Offender Regulations, could have resulted in a permanent license revocation in People v. Anonymous (Town Court, 7/2019).

 

In that case, Mr. Corletta, critically analyzing the case, also won the DMV Refusal proceeding, which, if decided adversely to the client, also would have resulted in permanent revocation.

 

Then turning to the criminal matter, Mr. Corletta achieved not 1, but 3 separate dismissals of the charges for defective Accusatory Instruments, utilizing several legal arguments, and noting a virtual comedy of errors by police and prosecutors.

 

The result was a 9 page written Decision from the Town Justice, agreeing with Mr. Corletta’s arguments, which was also published in New York Official Reports, as are many of Mr. Corletta's cases, which are cited frequently.

 

As a result, the client, who has now reached middle age, still has the ability to operate a motor vehicle in New York State.
