Like most states, Kentucky takes intoxicated driving very seriously. The consequences of driving under the influence escalate with each consecutive offense. 4 Kentucky DUI Penalties

1. First DUI Offense

This offense is a misdemeanor, which minimizes the amount of jail time you may receive. You may also be required to participate in an authorized 90-day addiction treatment program. Your driver’s license will be suspended for a minimum of 30 days and the maximum penalty is 120 days if you are convicted of DUI.  There are also fines that apply if convicted. If you committed aggravated DUI and are convicted, the penalties are increased

2. Second DUI Offense

A second offense brings potential fines up to $350 to $500, while increasing the potential jail time to a period of one week up to six months. A longer addiction treatment program is required and you can expect your driver’s license to be suspended for up to 18 months, though a DUI attorney may help you petition for a hardship license and possibly an interlock device. You may also be required to engage in community service.

3. Third DUI Offense

Still considered a misdemeanor, you’ll be expected to pay a fine of $500 to $1,500 and you’ll be required to serve a jail sentence of 30 days up to a year if convicted. Your license can be suspended for up to 36 months. You may also be required to participate in a community service program and attend alcohol or substance abuse treatment. 

4. Fourth DUI Offense

As a class D felony, you’ll be expected to pay a fine of over $1,500, with the exact amount to be determined by the judge. A DUI attorney may be able to negotiate for a reduced financial penalty. The minimum sentence is 120 days, or 240 in aggravated cases. You may have to participate in a addiction treatment program and you should expect your license to be suspended for 60 months. You may also be compelled to perform community service for up to a year.
