When designing wills, trusts, and other estate planning documents, it’s important to work with an attorney. 1. Gather the Necessary Paperwork

An attorney will need to have a realistic picture of your estate and the assets you hold, both individually and jointly. This information is most accessible when provided in certain pieces of paperwork. Write out a list of all your assets and liabilities, including checking and savings account balances, real estate and valuables you currently own, and the totals of any monies kept in securities or mutual funds. Also, make a list of the beneficiaries to be included in your estate plan. Collect all life insurance policies to bring along to the appointment.

2. Consider Guardianship

Think carefully about who you want to appoint and be sure to discuss the matter thoroughly beforehand with the individual you choose. Also, choose backup guardians in case the first choice is unavailable to take on the responsibility.

3. Decide on a Power of Attorney

A power of attorney is someone who acts on your behalf in some or all financial-, legal-, and healthcare-related matters should you become unable to do so, usually because of illness or infirmity. In choosing someone to appoint, make sure they are a trustworthy individual. If the unforeseen happened tomorrow, you should feel confident in having them take over your affairs. You can specify exactly what decisions they would have the power to make. As with guardianship, discuss this matter at length with the preferred individual before appointing them in any legal paperwork.
