The Fourth of July is almost here, and for countless Americans, that means one thing—fireworks. On any given day, you can drive around and see signs from places outside of Ohio that sell fireworks. However, in Ohio and many other states, there are strict laws in place regarding the use of fireworks. Disobey these laws, and you could find yourself needing a defense attorney. Here’s a closer look at the state’s fireworks laws.

Which Fireworks Are Legal?

defense attorneyOhio has some of the nation’s most restrictive laws regarding the use of fireworks. Though novelty fireworks, such as sparklers and snaps, can be purchased and used by almost anyone, consumer fireworks, like firecrackers, roman candles, and bottle rockets, have several noteworthy restrictions.

While anyone over the age of 18 can buy these fireworks, nonlicensed users must sign an affidavit affirming that they will take their purchase out of the state in less than 48 hours. To use consumer fireworks in-state, buyers must obtain an exhibitor’s license. This requires filling out an application fee and passing a fireworks proficiency exam. If you have been convicted of a felony, however, you cannot obtain this license.

What Are the Consequences of Using Illegal Fireworks?

The act of discharging consumer fireworks in Ohio without a license has serious consequences. This offense is considered a first-degree misdemeanor. Punishments can include a fine of up to $1,000 or even as much as six months in jail—or longer if you’ve been charged multiple times. Consequences for illegally using professional-grade fireworks can be even more severe, so avoid the need for a defense attorney by following fireworks laws this Fourth of July.

As much as fireworks are a common part of the holiday festivities, a license is needed to avoid being charged with a misdemeanor or felony. If you need a defense attorney, contact James F.
