Whether you’re buying or selling a home, Massachusetts law requires a real estate attorney to be present and participate in the process. If your transaction involves a mortgage, the lender will have a lawyer representing their interests. It’s wise to hire an attorney and get answers to questions such as those below before you make a selection.

What to Ask a Real Estate Attorney

1. How Many Real Estate Transactions Have You Done?

You want to know their level of experience and how much of the lawyer’s practice is focused on real estate transactions. A real estate attorney who performs closings as a large percentage of their work probably has a deep knowledge of the law, a keen eye for spotting problems, and experience in resolving them. Find out what issues they see might arise before closing.

2. What Puts You Above Your Competitors?

3. What Are Your Fees?

You want to know what the attorney fees are and how and when they’re paid. Some attorneys charge a flat fee for a closing and others charge by the hour. Ask what the fee covers and whether there are other costs you must pay.
