After an accident, auto insurance companies want to know who was responsible. The assignment of fault is typically a factor in determining who will benefit from a claim filing. Most states use one of two insurance laws regarding fault: “at fault” and “no-fault.” Here’s a helpful guide on the differences between these laws in Maryland and Pennsylvania.

At-Fault Insurance

Drivers in Maryland are governed by at-fault insurance laws. In other words, if you live in the state and are involved in an accident that’s determined to be your fault, your insurance company pays. The payout includes costs for vehicle and property damage and the physical injuries of others.

Maryland is among a handful of states that follow the Pure Contributory Negligence law. Essentially, if you are found to have caused the accident, even in a minor way, your auto insurance company may decline to pay for the affected person’s recovery costs.

No-Fault Insurance

auto-insurancePennsylvania is a no-fault insurance state. When an accident occurs, each person involved is able to receive vehicle damage and injury costs, regardless of who was at fault. Drivers in Pennsylvania must choose one of two choices when they secure their auto insurance policy: full tort and limited tort.

Under full tort, a driver in Pennsylvania can sue the other driver to pay for medical bills and lost wages associated with the accident. Limited tort doesn’t provide this option. Instead, the driver will need to file a claim with their auto insurance carrier. Even if they’re at fault for the accident, their insurance company will pick up the tab for medical bills and lost wages. Expenses for pain and suffering or emotional distress aren’t covered under limited tort.
