Drinking and driving puts you and those around you in danger. If you're caught, it also results in hefty penalties. In the state of New York, a conviction of DWI (driving while intoxicated) may lead to loss of license, fines, and jail time. A DWI defense attorney can help mitigate the consequences. Learn more about how DWI charges are handled in New York.

How Can You Get a DWI in New York?

A BAC (blood alcohol content) of more than 0.08% will earn you a DWI in New York. If you're under the age of 21, any traces of alcohol in your system will qualify. If your BAC is between 0.05% and 0.07%, you may receive a DWAI (Driving While Ability Impaired) conviction.

New York is an implied consent state, meaning that you’ll be punished if you refuse a chemical test. You may face a license revocation as well as a civil penalty of up to $500. You can also get a DWI charge if you show other signs of being impaired — no BAC test is needed.

What Are the Consequences of a New York DWI?

A first-time DWI in New York will result in a six-month license revocation, a fine of at least $500, and a state surcharge of $400. An interlock ignition (which you must pay for) must be installed on your vehicle for at least six months.

If you receive a second DWI within ten years, you will face felony charges, fines of up to $5,000, and up to four years in prison. You’ll also lose driving privileges for 18 months.

A third offense will result in fines of up to $10,000 and as much as seven years in prison, as well as an 18-month-long license revocation.

Why Should You Get a DWI Defense Attorney?

A DWI charge is permanent and can't be expunged. In other words, it’ll stay on your record for life. This can influence your chances of getting jobs, apartments, and educational opportunities in the future. With a DWI defense attorney on your side, you stand a better chance of beating a DWI charge and keeping your record clean.
