1. You Can Get a DWI Even If You’re Not Driving

According to Texas law, DWI means “operating” a vehicle with a prohibitively high BAC. The term “operating” is purposefully ambiguous and can refer to actions such as listening to the car’s radio, waiting for your heater to warm the car, or sleeping inside while the keys are in the ignition.

2. There Is Zero Tolerance for Underage Drinking & Driving

DWITexas law states that those under 21 years of age are considered “minors” and are prohibited from driving with any traces of alcohol in their system. Therefore, you will still get in trouble even if your BAC is under 0.08%. Possible penalties associated with this include community service, fines, probation, compulsory enrollment in an alcohol education class, the installation of an interlock device, and possibly jail time. 

3. Adult Offenders Will Face Harsh Penalties

If you are over 21, a first DWI offense in Texas may result in a jail sentence of up to six months and a fine of $2,000. You may also be required to attend a DWI program. If you have a prior offense, fines can reach up to $4,000, and you can spend up to a year in prison. Succeeding offenses can put you in state prison for up to 10 years, with fines of up to $10,000. All these are on top of a possible license suspension and installation of an ignition interlock device.
