What should I know about the property before I rent?

Before you sign anything, you have the right to inspect the premises. This includes checking that the electricity, heating, and air conditioning function in every room; the plumbing is in working condition; and the windows and doors are secure. If you’re sharing off-campus housing with other students, all roommates should conduct an inspection before signing the lease. Make sure everyone understands the cost of rent and knows whether or not utilities are included.

Who is responsible for property maintenance?

Unlike in residence halls, routine minor repairs in off-campus housing are your responsibility. However, the landlord must perform essential repairs to keep the property safe and in compliance with local housing codes. Also, they must inform you how to contact the person in charge of maintenance.

How can a tenancy be terminated?

However, some rental agreements may contain provisions that automatically renew the lease unless you give advance notice of termination. For monthly rentals, either you or the landlord may terminate the rental agreement by giving the other party written notice at least 28 days in advance of the next date rent is due. If you fail to pay rent on time, the landlord may serve an unconditional quit notice, giving you 14 days to move out before being evicted.

Is the landlord required to return my security deposit?

When you move out, the landlord has 21 days to return your security deposit. However, if you are moving out before your lease ends, the 21-day period counts from the last day of your lease or from the day a new tenant moves in, whichever comes first. The landlord may withhold part or all of your security deposit for damage, unpaid rent, or utility bills paid by the landlord. If they withhold any of your security deposit, they’re required to provide a written statement itemizing the deductions.
