Since the rise of the #metoo movement, workplace harassment has been a fixture of the news and a staple of boardroom discussions. However, little has been said about what to do if you are accused of this type of behavior. In addition to consulting an attorney, you should take some steps to protect yourself. Below is a guide to workplace harassment defense.

Meet With HR

Your first step should be to meet with your human resources representative. Your manager should be present, as well. Find out the details of the allegation: when and where was it supposed to have happened, and who is making the accusation?  Ask for specific times and dates and any evidence that has been brought against you. Admit nothing, but explain that you are willing to cooperate and get to the bottom of the situation.

Consult an Attorney

They will clarify what rights and responsibilities you have, what hurdles the accuser must navigate, and what consequences you face. Meanwhile, cease contact, if possible, with the accuser.

Tell Your Side of the Story

With advice from your attorney, complete a written statement that tells HR and management what happened from your point of view. This gives the company representatives something to refer to during the investigation. If you have an alibi for the time and date, supply that, and provide the names and contact information for any witnesses who can corroborate your side of the story.
