If you’re an OTR driver — someone who hauls cargo “over the road” for long distances — there’s a chance you’ll get a speeding ticket at some point. This isn’t because you’re reckless; it’s simply because the odds of getting pulled over are much higher if you spend your entire working day behind the wheel. Because OTR drivers travel so far from home as part of their job, they're often ticketed out of state. If you’re cited for speeding in Ohio, keep the following tips in mind before seeking out an attorney

Do:

Try to fight the ticket.

Under federal law, commercial drivers can’t negotiate to have a moving violation reduced to a lesser offense. In other words, the only possible outcomes of your case are a citation for speeding or total dismissal. While one ticket may not necessarily affect your CDL status, any subsequent offenses could. As such, it’s worth fighting the ticket so your driving record remains clean. 

Consider telling your employer.

Review your employment contract to determine if you’re obligated to report the violation to your boss. Many motor carriers require drivers to disclose citations, even if they're not found guilty. Additionally, some states require truckers to notify their employers of any violations, regardless of whether they occurred in a company vehicle. 

Don’t:

Pay the fine before talking to a lawyer.

attorneyPaying the fine may seem like the easiest way to resolve the situation. It’s certainly less work than traveling back to Ohio to appear in court so you can fight the ticket. However, doing so will affect your driving record and, subsequently, could affect your employment status.
