Cesspools are wastewater containers designed to store incoming sewage from residential properties. However, they’re a danger to the surrounding environment due to their inability to filter out contaminants. Hawaii is the last state to pass a law banning the construction of new cesspools, yet there are thousands that still exist on the islands. If you have a cesspool on your property, learn more about the advantages offered to you by Acts 125 and 120 when you convert to a septic installation.

What Is Act 125?

septic installationCesspools are contributing to the contamination of the ocean and local water sources with pathogens and bacteria, which is why Act 125 was passed in 2017. It states that all cesspools must be converted to a septic system, upgraded to an aerobic treatment system, or connected to a local sewer by Jan 1, 2050. However, many homeowners are struggling with the costs involved in making these changes.

How Does Act 120 Work?

Hawaii signed Act 120 as a temporary solution to help homeowners cover the costs of a septic installation. If you upgrade or convert a qualified cesspool to a septic tank system, aerobic treatment unit system, or sewer system connection, you can qualify for a tax credit of up to $10,000 per cesspool conversion. The tax credits for a septic installation are available for up to five years, and it ends in 2020.

What Is a Qualified Cesspool?

Only homeowners with qualified cesspools can take advantage of Act 120. The cesspool must be located within 500 feet of a shoreline, perennial stream, wetland, or within a source water assessment program area.
