Divorce is never easy, but it doesn’t have to be a complex process; you can hire a lawyer to file a nonadversarial divorce, which is a simplified version of the divorce process. The state of Connecticut has specific requirements for those who wish to file one. Here is a guide to the benefits and how to determine if you and your spouse qualify.

A Guide to Nonadversarial Divorces

Why Is It Desirable?

A nonadversarial divorce allows you to obtain a divorce within 35 days; you can avoid the normal process, which takes at least three months. You won’t have to go to court and appear before a judge, reducing the stress. You will also save on lawyer fees, as the process requires less time, paperwork, and negotiations.

What Are the Eligibility Parameters?

lawyerCouples who meet certain parameters may be eligible for a nonadversarial divorce. Here are the main ones:

  • Married for nine years or less.
  • A woman may not be pregnant
  • No children together (either during the marriage or before it)
  • Both parties may not have interest or title in a property
  • The total value of all property owned by both spouses must be under $80,000.
  • Neither party can have a benefit pension plan or pending bankruptcy case
  • No restraining or protective orders among the spouses
  • No other pending action for the dissolution of the marriage.

If you meet these requirements, a lawyer can help you fill out the necessary forms and walk you through the notarization process. The forms will eventually be filed with the Clerk of the Court.
