What Are the Eviction Rules for Landlords?

If a tenant has violated their lease, a landlord’s first step should be to address the matter and give the lessee time to comply. In Ohio, the notice is three days before the tenant is required to leave.

Keep in mind, the tenant can generally remain in the rental unit while the eviction paperwork is being processed. Once the eviction is filed with the court, a sheriff is given authority to evict the tenant on the day of contact.

What Happens After a Tenant Is Evicted?

The tenant may have left behind personal property after an eviction. While most states have laws on the books on how to handle abandoned property, Ohio has a bit more flexibility. Attorneys advise landlords to send written documentation to the former tenant informing them that they have a certain amount of time to pick up their property. The landlord can get rid of it if the owner does not claim it by the stated date in the notification letter.

Landlords are entitled to change the locks after a sheriff has legally evicted the tenant. If the former tenant wants to retrieve their property after the locks have been changed, they can contact the landlord for access. Retrieval must take place by the date provided by the landlord in the letter for property pickup.
