Many couples draft prenuptial agreements to reach an agreement on important issues like how to raise their kids and divide assets throughout their marriage and in the event of a divorce. What Should You Include in a Prenup?

1. Jewelry

Many couples fail to include jewelry in the prenuptial agreement, particularly the engagement ring. Ask each other the following questions: If the marriage doesn't last, should the ring be returned to the groom, or should it stay with the bride? Additionally, have other pieces of jewelry changed hands that should be given back? For instance, has the bride given the groom a wristwatch or other item that’s a family heirloom? If so, have your lawyer include those in the prenup.

2. Pets

lawyerAlthough many people consider pets part of the family, they are considered property according to the law and are subject to equitable distribution. If you share a dog or cat, decide who will care for them in the event of a divorce.

3. A Gag or Goodwill Clause

The anger that arises during many divorce proceedings can lead to both parties lashing out on social media or other public forums. Embarrassing photos or stories could damage your business or reputation, so have a lawyer add a gag or goodwill clause to your prenup that subjects the violator to a fine if they embarrass you publicly.
